A Brief Summary of International Seminar on "Supply Chain Due Diligence Legislation: Trends and |

On June 15, 2022, the "International Seminar on Supply Chain Due Diligence Legislation: Trends and Challenges" was successfully held through virtual format with more than 1,800 views in real time. The seminar was initiatiated by the Centre for the Study of Human Rights at Nankai University and jointly organized by CNTAC and China Chamber of Commerce of Metals, Minerals & Chemicals Importers and Exporters (CCCMC).
The Seminar gathered well-known scholars and industry experts from China, Britain, Germany, Norway, Sweden, Denmark, Portugal, Chile and other countries and regions, conducting in-depth exchanges and discussions on international development in human rights and environmental due diligence, Chinese policies and practices of supply chain due diligence, and multi-stakeholders' perspectives on international supply chain due diligence legislations. The Seminar attracted many representatives from Chinese and foreign enterprises, , academia and industry organizations, where a dialogue and exchange platform on related topics was set up for the first time in China.

Prof. Song Hualin, Vice Dean, Nankai University School of Law, presided over the opening ceremony of the Seminar. Prof. Chang Jian, Director of Centre for the Study of Human Rights at Nankai University, Mr. Chen Dapeng, Vice President of CNTAC, and Mr. Jiang Hui, President of CCCMC, respectively delivered opening speeches. As one of the main supporting units of the Centre for the Study of Human Rights at Nankai University, Nankai University School of Law provided great support to the Seminar. In addition, Office for Social Responsibility of CNTAC and the Responsible Cobalt Initiative (RCI) co-organized this Seminar.
The discussions of the Seminar are divided into three sessions as follows: International Development in Human Rights and Environmental Due Diligence; Chinese Policies and Practices of Supply Chain Due Diligence, and Multi-Stakeholders' Perspectives on International Supply Chain Due Diligence Legislations.
✦ Session I ✦ " International Development in Human Rights and Environmental Due Diligence "
It was presided by Dr. Liang Xiaohui, Chief Researcher of Office for Social Responsibility of CNTAC. Claire Bright, Associate Professor & Director of the NOVA Centre on Business, Human Rights and the Environment at NOVA Law School in Lisbon, Portugal, as well as Associate Research Fellow at the British Institute of International and Comparative Law, delivered a speech on the Background and legislation procedure of the EU Corporate Sustainability Due Diligence Directive. Franca Maurer, Researcher, International Human Rights Policy Department of the German Institute for Human Rights, Germany, introduced the Development of the German Act on Corporate Due Diligence in Supply Chains. Bård Anders Andreassen, Director & Professor, Norwegian Center for Human Rights, Norway, commented on the Norwegian Transparency Act and Mandatory Human Rights Due Diligence. Gabrielle Holly, Senior Adviser, Human Rights and Business, Danish Institute for Human Rights, Denmark, made a comprehensive comparison on the Trend of Supply Chain Due Diligence Legislations: From US and Europe to other Jurisdictions, and analyzed the development trend of such legislation and its extraterritorial impacts.

✦ Session II ✦ "Chinese Policies and Practices of Supply Chain Due Diligence"
Prof. Zhang Wanhong, Dean, Institute for Human Rights Studies of Wuhan University, presided the meeting; Tang Yingxia, Deputy Director, Centre for the Study of Human Rights at Nankai University & Associate Professor of Law, systematically sorted out China's Legal and Policy Framework of Human Rights and Environmental Due Diligence; Sun Lihui, Director, Department of Development, CCCMC and Chairman of RCI, introduced specifically Human Rights Due Diligence Practices of Chinese Mining Supply Chains, its impact and development prospects at home and abroad as well as the launch background, objectives and achievements of RCI; Professor Wang Xiumei from Law School of Northwest University analyzed Due Diligence in Tort Litigations against Transnational Corporations and its Implications on China; and Wang Huiru, Lecturer from School of Law, Beijing Institute of Technology discussed the Theory and Practice Boundary of Supply Chain Human Rights Due Diligence and its Influence and Enlightenment on Chinese Overseas Investment.

Prof. Lu Zhian, Deputy Executive Director, Center for Human Rights Studies of Fudan University, served as the moderator. Prof. Dante Pesce, Executive Director, VINCULAR Center for Social Responsibility and Sustainable Development at the Catholic University of Valparaiso, Chile, former Member of UN Working Group on Business and Human Rights, had a discussion on Mandatory Human Rights Due Diligence Legislations and the Implications of Their Implementation in Developing and Emerging Economies; Barbara Bijelic, Financial Sector and Regulatory Engagement Lead, Centre for Responsible Business Conduct, OECD, sorted out the relationship between the OECD and Mandatory Human Rights Due Diligence Legislations; Radu Mares, Senior Researcher on Business and Human Rights, Raoul Wallenberg Institute of Human Rights and Humanitarian Law, Sweden, analyzed the Company Law and Duties of Managers under the EU Corporate Sustainability Due Diligence Directive; Axel Schröder, Sustainability Manager (Human Rights), Tchibo GmbH, Germany, shared his approach towards Mandatory Supply Chain Due Diligence, also his suggestions and expectations towards Chinese cooperative partners.

In February this year, the EU just released the draft legislation of EU Corporate Sustainability Due Diligence Directive, which is the latest trend of Western countries' legislation on human rights due diligence in the supply chain. Previously, some countries like the United Kingdom, Australia, Netherlands, Germany, and Norway have already adopted similar legislations and directives. All of these legislations adopted the standard of mandatory human rights due diligence, requiring local and domestic enterprises to implement due diligence management obligations, with possible obligatory responsibility on surveillance human rights and environmental impacts in their supply chains and shall assume corresponding civil or administrative liabilities for breach of duty. As one of the most important investment and trade partners in these markets, Chinese enterprise could be significantly affected by this. This Seminar is conducted to analyze the core obligations and scope of application of these legislations, and their impact on Chinese enterprises, and to provide references on China's response to the major new challenges in the supply chain. |
